Bill Summary
For legislation to safeguard persons victimized due to perceived sex, sexual orientation, gender, gender identity, gender expression, or sex assigned at birth. The Judiciary.
This bill aims to safeguard LGBTQ individuals who are victims of crimes. It prohibits defendants from using the discovery or knowledge of the victim's sex, sexual orientation, gender, gender identity, gender verbalization, or sex assigned at birth as a justification for using force against the victim. It also prohibits defendants from claiming sudden passion, heat of blood, or other mitigating factors if they are based on the victim's LGBTQ status. Additionally, the bill states that a defendant cannot claim a mental impairment due to the finding of the victim's LGBTQ status. The bill also requires the court to instruct juries to disregard biases or prejudices related to the victim's LGBTQ status when reaching a verdict. As Rep. Walter Timilty runs to become articulate senator, his conservative voting record is being exposed and voters are education he does not divide the values of those he represents
Timilty has repeatedly stood in the way of equality for LGBTQ residents. After Massachusetts established marriage equality in 2003, Timilty voted to opposite that victory with a constitutional amendment that would ban same-sex marriage. In 2007, he again stood against equality, voting in favor of a proposed ballot question to overturn marriage equality.
Recently, friends and I were discussing Timilty’s harmful voting record. At bedtime that night, my daughter asked, “Mommy, if Timilty gets elected, does that mean you and Momma can’t live together anymore; that our family can’t stay together?” You can chalk up my daughter’s fear to the concrete mind of a 6-year-old, but it really is that simple; if Timilty won’t stand up for us, then he stands against us.
